Kathleen W. Toth, Esq.

Kathleen W. Toth, Esq. Kathleen W. Toth began her law practice in 1994. While serving a federal clerkship in the United States District Court for the Southern District of Texas, Kathleen assisted with the litigation and resolution of several employment law cases. In doing so, she discovered that her real passion was practicing employment law. During the 16 years since her clerkship, Kathleen has developed and established an expertise in employment law. She spent the first years of her career in Houston, Texas at Littler Mendelson, a national firm specializing in employment-related litigation and counseling. In 1999, Kathleen returned to Utah where she has spent the last eleven years exclusively practicing employment law. During her career, Kathleen has counseled hundreds of employers and employees on virtually every aspect of the employment relationship. In addition, Kathleen has litigated cases for both employers and employees. As a result of both her counseling and litigation experience, Kathleen has a keen understanding of employment-related issues and is able to effectively communicate, mediate and resolve issues that arise between an employer and employee.

Specifically, Kathleen has handled disputes involving employment contracts, including non-competition, non-solicitation and severance agreements, employee privacy issues, all Title VII protected classes, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Fair Labor Standards Act, the Family Medical Leave Act, and employment-related state law tort claims.

Kathleen has been recognized by The Best Lawyers in America for Labor and Employment Law, and has been elected to Utah's Legal Elite for Employment law by Utah Business magazine. Kathleen has authored several articles advising both employees and employers alike and is a well-known speaker on employment issues. Kathleen has participated in numerous mediations, successfully representing both the employee and the employer. She is committed to expanding her extensive employment counseling and litigation experience to help others resolve their disputes successfully.
